Texas Power Bars Terms of Service
These Terms govern access to and use of the Texas Power Bars website, store, products, content, ordering systems, and related services.

Please read these Terms carefully. By using our website, creating an account, or submitting an order, you agree to these Terms and the policies that apply to your transaction.
1. Overview and Applicable Policies
This website is operated by Texas Power Bars LLC. “Texas Power Bars,” “we,” “us,” and “our” refer to Texas Power Bars LLC. “Service” includes our website, Shopify store, products, ordering systems, digital content, customer support, and related tools and services.
The Texas Power Bars Privacy Policy, Shipping Policy, Return Policy, Warranty Policy, product-page disclosures, promotion terms, quotes, invoices, order confirmations, purchase-order terms, wholesale terms, custom-order terms, and separately signed agreements apply as relevant.
Clearly disclosed product-specific or transaction-specific terms control over conflicting general terms for that product or transaction. A separately signed agreement controls to the extent of a direct conflict.
Nothing in these Terms waives or limits a right that cannot lawfully be waived or limited.
2. Eligibility, Accounts, and General Conditions
You represent that you are legally able to enter into a binding agreement. If you permit a minor to use the Service or a product, you are responsible for appropriate supervision and safety to the fullest extent permitted by law.
You agree to provide current and accurate account, billing, payment, contact, tax, and delivery information. You are responsible for account security and activity through your account.
We may refuse service, restrict access, limit purchases, hold orders, or cancel transactions for lawful business, safety, security, fraud-prevention, sanctions-compliance, inventory, operational, or policy-enforcement reasons.
You may not copy, sell, commercially exploit, or gain unauthorized access to any part of the Service without written permission.
3. Products, Specifications, and Availability
Texas Power Bars has hand-built barbells in Texas with American steel since 1980. We work to provide accurate product descriptions, specifications, images, approvals, availability, and pricing.
Product details may change as designs, materials, components, finishes, manufacturing methods, approvals, packaging, or generations evolve. Texas Power Bars may improve, substitute, modify, or discontinue a product or component when reasonably necessary, provided the fulfilled product remains materially consistent with the description applicable to the order.
Published weights, lengths, diameters, sleeve dimensions, tensile strengths, colors, and other measurements are target specifications unless a specific guaranteed tolerance is expressly stated. Minor variations within normal manufacturing tolerances do not necessarily affect performance or indicate a defect.
Hand-building, steel, machining, coating, and assembly may produce minor cosmetic variation. Product appearance may vary with lighting, screens, materials, texture, or production batch.
Barbells are working strength equipment. Rack contact, plates, collars, chalk, sweat, straps, cleaning, transportation, storage, and use may cause sleeve marks, scratches, coating wear, discoloration, oxidation, patina, surface rust, or changes in knurl feel.
Bare Steel has no rust- or corrosion-resistant coating, requires regular maintenance, and will naturally develop patina and may develop surface rust.
Customers are responsible for reviewing specifications and confirming compatibility with plates, collars, racks, platforms, storage systems, training spaces, delivery access, and third-party equipment before ordering or use.
Availability, preorder dates, backorder dates, and production estimates may change. Placing an item in a cart does not reserve inventory.
4. Product Safety and Assumption of Risk
Strength training and use of barbells and related equipment involve inherent risks of property damage, bodily injury, permanent disability, paralysis, and death.
Product users are responsible for proper technique, suitable equipment, appropriate flooring and platforms, adequate space and clearance, spotters and safeties when appropriate, routine inspection, maintenance, storage, and compliance with intended-use limitations.
Stop using any product immediately if bending, cracking, loosening, unusual movement, damage, or another unsafe condition is suspected.
Never drop or dump a loaded bar onto rack pins, safety arms, straps, boxes, benches, metal surfaces, or other equipment. Concentrated, uncontrolled, angled, or abnormal impact can damage or permanently bend any barbell.
No strength product can eliminate all risk. Tensile strength, materials, durability, or performance statements are not promises that a product is indestructible or safe under every load, impact, misuse, modification, or training condition.
To the fullest extent permitted by law, Texas Power Bars is not responsible for injury, death, or property damage caused by misuse, improper technique, incompatible equipment, unauthorized modification, neglect, inadequate supervision, failure to inspect, improper storage, lack of maintenance, abnormal impact, or use outside intended purpose.
Website content, recommendations, videos, emails, social posts, and support communications are general information and are not medical, engineering, legal, coaching, or professional safety advice.
5. Orders, Payment, and Chargebacks
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily constitute final acceptance. Texas Power Bars may review availability, price, shipping, payment authorization, fraud indicators, address information, resale intent, and legal restrictions before accepting an order.
Contact us promptly to request changes or cancellation. Requests cannot be guaranteed after an order enters production, customization, fulfillment, packaging, label creation, freight booking, or carrier processing. Approved changes or cancellations may be subject to price differences, shipping adjustments, processing costs, production expenses, customization charges, packaging expenses, or freight-booking fees.
Texas Power Bars may limit or cancel quantities or orders that appear fraudulent, unauthorized, duplicative, automated, promotional abuse, resale-restricted, or otherwise inconsistent with applicable terms.
Customers remain responsible for amounts lawfully owed, including products, taxes, shipping recalculations, carrier fees, and approved custom-order costs.
Contact Texas Power Bars if you believe a charge is incorrect. Texas Power Bars may contest an inaccurate, unsupported, fraudulent, or improper chargeback using transaction records, communications, product descriptions, policy disclosures, shipping records, delivery confirmation, photographs, and other relevant documentation.
A payment dispute does not automatically cancel an order, create return eligibility, establish a defect, or eliminate amounts lawfully owed. Nothing limits lawful rights to dispute unauthorized or incorrect charges.
6. Pricing, Promotions, and Errors
Prices, configurations, shipping rates, promotions, and availability may change before order acceptance.
Discount codes, affiliate codes, wholesale pricing, sponsorship pricing, free-shipping offers, free gifts, gift cards, and other promotions generally cannot be combined unless expressly stated.
Promotions may be limited by product, customer, household, address, payment method, quantity, inventory, destination, channel, or date. Texas Power Bars may modify, suspend, extend, or cancel a promotion before order acceptance and may adjust or cancel orders that violate or appear to manipulate the offer.
Discounts generally must be applied during checkout and are not guaranteed retroactively. Later sales do not automatically create a right to a price adjustment.
The Service may contain errors or omissions involving descriptions, specifications, pricing, promotions, shipping, inventory, or availability. Texas Power Bars may correct an error, offer the option to proceed at the corrected amount, or cancel and refund the affected unfulfilled portion as required by law.
7. Shipping, Returns, and Warranty
Processing, shipping, freight, delivery, inspection, damage, shortage, international, refused-shipment, and shipping-recalculation terms are governed by the Texas Power Bars Shipping Policy and any applicable order-specific documentation.
Returns, exchanges, cancellations, restocking fees, final-sale items, return shipping, refunds, and geographic limitations are governed by the Texas Power Bars Return Policy.
Warranty coverage, normal-use requirements, misuse exclusions, finish and rust exclusions, geographic limitations, claim requirements, remedies, and product-specific coverage are governed by the Texas Power Bars Warranty Policy.
Not every product has the same return or warranty eligibility. Custom, Cerakote, Cosmetic Blemish, clearance, closeout, specialty, oversized, freight-only, partner, resale, and product-specific items may have different, limited, or no coverage.
Do not return, ship, disassemble, repair, alter, or modify a product unless Texas Power Bars first provides written authorization and instructions. A request, claim, photo, or video does not automatically establish eligibility or guarantee a particular resolution.
8. Custom, Wholesale, Dealer, and Resale Terms
Quotes, invoices, and purchase orders are subject to written approval, availability, payment terms, freight review, minimum quantities, and any additional transaction terms. Submission does not reserve inventory or begin production until requirements are satisfied.
Custom, personalized, co-branded, made-to-order, and specially configured products may require design approval, deposits, advance payment, minimum quantities, longer lead times, and additional production or freight charges.
Once approved or placed into production, custom products are generally noncancelable, nonreturnable, and nonrefundable except where required by law or expressly agreed otherwise in writing.
By supplying a name, logo, trademark, image, design, or other material, you represent that you have the rights required for Texas Power Bars to use it to quote, design, manufacture, package, and fulfill the order.
Wholesale, dealer, distributor, facility, meet-director, sponsorship, and affiliate programs are subject to approval, separate terms, pricing, payment requirements, sales-channel restrictions, and periodic review.
Commercial online resale of new Texas Power Bars products is prohibited unless expressly authorized in writing. This does not prohibit an individual from lawfully reselling a personally owned used product.
9. Third-Party Services
The Service may use or provide access to third-party products, payments, financing, eligibility tools, carriers, social platforms, analytics, content, and services.
Third-party services are subject to their own terms, privacy practices, eligibility rules, warranties, and policies. Texas Power Bars does not control independent third-party decisions, outages, financing terms, reimbursement decisions, carrier performance, or data practices.
Partner or resale products may carry the original manufacturer’s warranty instead of a Texas Power Bars warranty.
10. Intellectual Property and User Content
The Texas Power Bars name, logos, trademarks, product names, trade dress, designs, photographs, videos, text, graphics, layouts, product descriptions, and technical content are owned by or licensed to Texas Power Bars and protected by law.
Without written permission, you may not commercially copy our content, imitate our branding, create counterfeit or misleading listings, remove ownership notices, or imply an unauthorized relationship.
You retain ownership of original content you create. When you voluntarily submit content to Texas Power Bars, you grant us a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, format, publish, display, distribute, and use it in connection with our business and marketing.
You represent that you have permission to submit the content. You may post lawful and honest reviews. Texas Power Bars may remove content that is unlawful, fraudulent, threatening, harassing, obscene, spam, malicious, privacy-invasive, or infringing.
11. Privacy and Electronic Communications
Personal information is handled under the Texas Power Bars Privacy Policy.
By using the Service or providing contact information, you consent to transactional electronic communications, including order confirmations, receipts, invoices, account notices, shipping updates, policy disclosures, and customer-support messages.
Marketing communications are subject to the consent and opt-out terms presented when you subscribe. Opting out of marketing does not prevent necessary transactional communications.
12. Prohibited Uses
You may not use the Service:
- For an unlawful, fraudulent, deceptive, or unauthorized purpose
- To violate law, sanctions, trade restrictions, or another party’s rights
- To submit false, misleading, fraudulent, or impersonated information
- To transmit malware, viruses, malicious code, or harmful technology
- To collect private information without authorization
- To spam, phish, scrape, crawl, harvest data, or circumvent security
- To manipulate inventory, promotions, reviews, or ordering limits through automation
- To create counterfeit, deceptive, or unauthorized commercial listings
- To harass, threaten, defame, abuse, or unlawfully discriminate
Texas Power Bars may suspend access or take other lawful action in response to prohibited use.
13. Disclaimers and Limitation of Liability
Except for express product warranties stated in the Texas Power Bars Warranty Policy, product-specific written terms, and rights that cannot lawfully be limited, the website, digital content, optional tools, and Service are provided on an “as available” basis.
Texas Power Bars does not guarantee uninterrupted, continuously available, completely secure, or error-free digital service.
No oral statement, informal message, social-media comment, advertisement, review, or support communication creates an additional warranty unless an authorized representative expressly identifies it as a warranty in writing.
To the fullest extent permitted by law, Texas Power Bars and its owners, employees, affiliates, agents, contractors, suppliers, and service providers are not liable for indirect, incidental, special, punitive, or consequential damages arising from the Service, third-party conduct, or use or misuse of products.
For claims and economic losses that may lawfully be limited, aggregate liability arising from a specific order or product will not exceed the amount actually paid to Texas Power Bars for that product or service.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
14. Indemnification and Events Outside Our Control
To the fullest extent permitted by law, you agree to defend, indemnify, and hold Texas Power Bars harmless from third-party claims arising from your material breach of these Terms, unlawful use of the Service, infringement of another party’s rights, commercial resale violations, or custom-order materials supplied by you.
Texas Power Bars is not responsible for delay or failure caused by events outside reasonable control, including severe weather, natural disaster, fire, flood, war, civil unrest, labor or transportation disruption, carrier failure, port congestion, material shortage, supplier interruption, utility failure, cyberattack, government action, sanctions, or import and export restrictions.
During such an event, Texas Power Bars may reasonably adjust timelines, divide shipments, substitute reasonably available components, offer an alternative, or cancel and refund an unfulfilled portion when appropriate and permitted by law.
15. Governing Law, Disputes, and General Terms
Before filing a legal claim, the parties agree to make a good-faith effort to resolve the dispute informally. Send a written notice with the relevant facts, order number, documentation, and requested resolution to team@texaspowerbars.com.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except that controlling federal law and nonwaivable consumer protections remain applicable.
To the fullest extent permitted by law, legal actions must be brought in a court of competent jurisdiction serving the Texas county in which Texas Power Bars LLC maintains its principal place of business, unless applicable law gives a nonwaivable right to proceed elsewhere.
If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
These Terms, applicable policies, product disclosures, and written order agreements constitute the agreement concerning the transaction and supersede prior communications on the same subject.
Texas Power Bars may assign these Terms in connection with a merger, financing, restructuring, sale, or transfer of the business. Customers may not assign an order or these Terms without written consent.
16. Changes to These Terms
Texas Power Bars may update these Terms prospectively by posting a revised version with an updated effective date. Additional notice will be provided when required by law.
Terms accepted for an existing transaction continue to govern that transaction as required by law.
